1. Acceptance of Terms
Welcome to ImpulsTrip. These Terms & Conditions ("Terms") constitute a legally binding agreement between you and ImpulsTrip ("ImpulsTrip," "we," "our," or "us") governing your access to and use of the ImpulsTrip iOS and Android mobile applications and any related services (collectively, the "App" or "Services").
By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the App.
Note: These Terms apply to all users of the App, including users of current features and upcoming social and content features such as short-form video content ("Clips") and community posting.
2. Nature of the Platform
ImpulsTrip is a mobile-first travel discovery and social community platform. The App enables users to:
- Discover and share travel trips, experiences, and destinations
- Create and post short-form video content (Clips) related to travel
- Follow other travelers and engage with community content
- Complete identity verification to access community features
- Access optional premium features via subscription
ImpulsTrip is a platform that connects users. We do not ourselves provide travel services, accommodation, transport, or any third-party service referenced within user-generated content. Any interactions between users, or between users and third-party services, are solely between the parties involved. ImpulsTrip is not a party to, and bears no responsibility for, such interactions.
3. Eligibility
You must be at least 18 years of age to create an account and use the App. By accessing or using the App, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into binding contracts in your jurisdiction
- All registration information you provide is accurate, current, and complete
- You are not prohibited from using the App under any applicable law
If you are under the age of 18, you may not use the App under any circumstances. ImpulsTrip reserves the right to terminate any account found to be held by a user under the age of 18.
Note: ImpulsTrip's minimum age requirement is 18. This applies to all features of the App, including Clips and social content. Our Privacy Policy separately addresses the collection of data and applies consistent age protections.
4. Account Registration and Security
To access certain features of the App, you must create an account. When registering, you agree to:
- Provide accurate, complete, and current information
- Maintain and promptly update your account information as needed
- Keep your login credentials confidential and not share them with any third party
- Notify us immediately at info@impulstrip.com if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
ImpulsTrip reserves the right to suspend or terminate accounts where registration information is found to be inaccurate, incomplete, or fraudulent, or where account activity violates these Terms.
5. Identity Verification
To maintain a safe, trusted, and authentic community, ImpulsTrip requires users to complete identity verification. Verification may include submitting a live selfie image for biometric face comparison using Amazon Web Services (AWS) Rekognition.
Verification is required to access certain features of the App, including social and Clips features. Failure to complete verification, or providing false or misleading information during verification, may result in:
- Restricted access to certain features
- Suspension of your account
- Permanent termination of your account
Your biometric data collected during verification is handled in accordance with our Privacy Policy, which governs its collection, use, storage, and deletion.
6. User Conduct and Community Standards
By using the App, you agree to conduct yourself in a manner that is lawful, respectful, and consistent with our community values.
6.1 Prohibited Conduct
You agree not to:
- Violate any applicable local, provincial, national, or international law or regulation
- Harass, threaten, bully, intimidate, abuse, or harm any other user or person
- Post, share, or transmit content that is defamatory, obscene, sexually explicit, hateful, violent, or otherwise objectionable
- Impersonate any person, organization, or entity, or misrepresent your affiliation with any person or entity
- Post misleading, false, or fraudulent travel content, reviews, or recommendations
- Engage in spam, unsolicited advertising, or promotional activity without our prior written consent
- Attempt to circumvent, disable, or interfere with our safety systems, identity verification, or security features
- Scrape, crawl, or extract data from the App using automated means without our prior written permission
- Upload or distribute viruses, malware, or other harmful code
- Use the App for any unauthorized commercial purpose
- Facilitate or encourage any of the above conduct
6.2 Content Standards for Clips and Posts
When posting Clips, photos, or other social content on the App, you additionally agree that your content will not:
- Depict or promote illegal activity
- Contain content that exploits, endangers, or sexualizes minors in any way
- Infringe the intellectual property, privacy, or publicity rights of any third party
- Contain another person's private or personal information without their explicit consent
- Misrepresent travel destinations, services, or experiences in a manner designed to deceive other users
ImpulsTrip reserves the right - but is not obligated - to review, monitor, remove, or restrict any content or account that violates these Terms or our community standards, at our sole discretion and without prior notice.
7. User-Generated Content and License
7.1 Ownership
You retain full ownership of all content you create, upload, or post through the App, including trips, Clips, photos, captions, and comments ("User Content"). These Terms do not transfer any ownership of your User Content to ImpulsTrip.
7.2 License Grant to ImpulsTrip
By posting or uploading User Content to the App, you grant ImpulsTrip a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, distribute, promote, and adapt your User Content for the purposes of:
- Operating, improving, and providing the App and its features
- Displaying your content to other users in accordance with your privacy settings
- Promoting the App and ImpulsTrip's services across our owned and operated channels
This license is limited to the purposes listed above. ImpulsTrip will not sell your User Content to third parties or use it for purposes unrelated to operating and promoting the App without your separate consent.
7.3 Your Representations
By submitting User Content, you represent and warrant that:
- You own the content or have all necessary rights and permissions to post it
- Your content does not infringe the intellectual property, privacy, or other rights of any third party
- You have obtained the consent of any identifiable individuals appearing in your content
- Your content complies with these Terms and all applicable laws
7.4 Content Removal
You may delete your User Content at any time through the App. Upon deletion, your content will be removed from public view. Residual copies may persist temporarily in our backup systems and will be deleted in accordance with our data retention schedule, as described in our Privacy Policy.
8. Intellectual Property
All content, features, branding, trademarks, logos, software, design elements, and materials that are part of the App and not created by users are owned by or licensed to ImpulsTrip and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, license, reverse-engineer, or create derivative works from any part of the App or its proprietary content without our prior written permission. Unauthorized use of ImpulsTrip's intellectual property may result in account termination and legal action.
The ImpulsTrip name, logo, and related marks are trademarks of ImpulsTrip. Nothing in these Terms grants you any right to use our trademarks.
9. Subscriptions and In-App Purchases
9.1 ImpulsTrip Premium
ImpulsTrip offers an optional auto-renewable subscription called ImpulsTrip Premium. The App can be used without a subscription. Premium features are optional enhancements and are not required to access core App functionality.
Current subscription pricing:
- Monthly: $9.99 CAD
- Yearly: $99.99 CAD
Prices may vary by region and are displayed in the App before purchase. ImpulsTrip reserves the right to change subscription pricing at any time. Any price changes will be communicated to existing subscribers with reasonable advance notice.
9.2 Premium Features
Premium features may include, but are not limited to:
- Enhanced AI-generated suggestions for trip titles and descriptions
- Editing of previously posted trips
- Premium badge visibility on your profile
The availability of specific premium features may change over time. ImpulsTrip does not guarantee that any specific feature will remain available for the duration of your subscription.
9.3 Billing and Auto-Renewal
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscription at any time through your Apple ID account settings
ImpulsTrip does not directly process payments and does not collect or store your payment card or financial account information. All transactions are governed by Apple's payment terms and policies.
9.4 Refunds
All subscription purchases are processed through Apple's In-App Purchase system. Refund requests are subject to Apple's refund policies and must be submitted directly to Apple. ImpulsTrip has no ability to issue refunds for purchases made through the App Store.
10. Third-Party Services and Links
The App may contain links to, or references to, third-party websites, services, applications, or content. These are provided for convenience only. ImpulsTrip does not endorse, control, or take responsibility for any third-party content, services, or websites.
Your interactions with any third-party service accessed through or referenced in the App are solely between you and that third party. ImpulsTrip is not liable for any loss or damage arising from your use of or reliance on any third-party service.
Third-party services used in the operation of the App - including AWS Rekognition and Apple's payment systems - are subject to their own terms of service and privacy policies.
11. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, ImpulsTrip expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content on the App, including user-generated content, Clips, and trip recommendations
- Any warranty regarding the outcomes of identity verification processes
ImpulsTrip does not warrant or guarantee any specific result from your use of the App. User-generated content, including Clips and trip recommendations, reflects the views of individual users and is not endorsed or verified by ImpulsTrip.
12. Limitation of Liability
To the maximum extent permitted by applicable law, ImpulsTrip and its officers, directors, employees, contractors, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, punitive, or exemplary damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Damages arising from reliance on any user-generated content, Clips, or travel recommendations posted through the App
- Unauthorized access to or alteration of your account or data
- Any conduct or content of any third party using the App
- Any failure or interruption of the App or its features
Where liability cannot be fully excluded under applicable law (including Canadian consumer protection legislation), ImpulsTrip's total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of: (a) the total amount you paid to ImpulsTrip in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $100.
Note: Nothing in this section limits or excludes liability for fraud, gross negligence, willful misconduct, or any other liability that cannot be excluded or limited under applicable Canadian law.
13. Indemnification
You agree to indemnify, defend, and hold harmless ImpulsTrip and its officers, directors, employees, contractors, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or access to the App
- Your User Content, including Clips, posts, and any other content you submit
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
ImpulsTrip reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which case you agree to cooperate with ImpulsTrip in asserting any available defences.
14. Account Suspension and Termination
14.1 Termination by ImpulsTrip
ImpulsTrip may suspend, restrict, or permanently terminate your account at any time, with or without notice, if we determine in our sole discretion that you have:
- Violated these Terms or our community standards
- Engaged in conduct that threatens the safety or integrity of the platform or its users
- Provided false information during registration or identity verification
- Used the App for unauthorized commercial or illegal purposes
- Failed to complete required identity verification
Where reasonably practicable and not prohibited by law or security considerations, ImpulsTrip will provide notice of suspension or termination and the general reason for the action.
14.2 Appeal Process
If you believe your account has been suspended or terminated in error, you may contact us at info@impulstrip.com within 30 days of receiving notice of the suspension or termination. We will review your appeal and respond within a reasonable timeframe. ImpulsTrip's decision on any appeal is final.
14.3 Termination by You
You may delete your account at any time through the App. Upon deletion, your account and associated personal data will be handled in accordance with our Privacy Policy. Obligations under these Terms that by their nature should survive termination - including intellectual property provisions, limitations of liability, indemnification, and dispute resolution - will continue to apply after termination.
15. Modifications to the App and Terms
15.1 Changes to the App
ImpulsTrip reserves the right to modify, update, suspend, or discontinue any feature, functionality, or aspect of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App or any feature thereof.
15.2 Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you by:
- Sending a notice to the email address associated with your account
- Displaying a prominent in-app notification
- Updating the "Last Updated" date at the top of these Terms
Your continued use of the App after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should discontinue use of the App and delete your account.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact ImpulsTrip at info@impulstrip.com and attempt to resolve the dispute informally. We will make reasonable efforts to resolve any dispute within 30 days of receiving written notice.
16.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be submitted to binding arbitration. The arbitration shall be:
- Conducted by a recognized arbitration body in accordance with its applicable rules
- Held in the Province of Ontario, Canada, or conducted remotely by mutual agreement
- Conducted in the English language
- Governed by Canadian federal law and the laws of the Province of Ontario
The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
16.3 Class Action Waiver
To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only and not as part of a class, consolidated, or representative action. If applicable law prohibits this waiver, the arbitration agreement in Section 16.2 will not apply, and disputes will be resolved in courts of competent jurisdiction.
16.4 Exceptions
Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm pending the outcome of arbitration.
17. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Subject to the dispute resolution provisions in Section 16, you agree to submit to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada for the resolution of any disputes not subject to arbitration.
If you are accessing the App from outside Canada, you are responsible for compliance with all applicable local laws. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence.
18. Apple App Store and Standard EULA
Your use of the App downloaded from Apple's App Store is also governed by Apple's Standard End User License Agreement (EULA), which is incorporated into these Terms by reference and is available at:

As between ImpulsTrip and Apple, ImpulsTrip is solely responsible for the App and its content. Apple has no obligation to provide any maintenance or support services for the App.
In the event of any conflict between these Terms and Apple's Standard EULA with respect to your use of the App, Apple's Standard EULA shall prevail.
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ImpulsTrip regarding your use of the App and supersede all prior agreements, representations, and understandings relating to that subject matter.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms if modification is not possible. The remaining provisions shall continue in full force and effect.
19.3 Waiver
ImpulsTrip's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by an authorized representative of ImpulsTrip.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without ImpulsTrip's prior written consent. ImpulsTrip may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets, without restriction or notice to you beyond what is required by applicable law.
19.5 Force Majeure
ImpulsTrip shall not be liable for any failure or delay in performance under these Terms arising from causes beyond our reasonable control, including acts of God, natural disasters, acts of government, pandemics, civil unrest, network or infrastructure failures, or other events outside our reasonable control. We will resume performance as soon as reasonably practicable following the cessation of such events.
19.6 Language
These Terms are written in the English language. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
